KEPUTUSAN MAHKAMAH RAYUAN


Keputusan 3 Hakim Mahkamah Rayuan pada 8-6-2010.

SETELAH Kami meneliti permohonan dan Affidavit Pemohon, Affidavit Responden-responden serta meneliti dokumen-dokumen yang difailkan, juga dengan meruju' kepada Hukum Syarak maka kami sebulat suara memutuskan bahawa :-


1. Semakan terhadap Perintah / Arahan mahkamah Tinggi Syariah bertarikh 4.10.2009 iaitu Perintah / Arahan yang dilakukan oleh Yang Arif Hakim-hakim Mahkamah Tinggi Syariah Kuala Terengganu yang memerintahkan / mengarahkan supaya MAIDAM sebagai Defendan / Pemohon di dalam tuntutan kes Mal No. 11200-099-0400 Tahun 2008 memberikan Notis secara Penyampian ganti melalui Notis di Papan Kenyataan Mahkamah Tinggi Syariah di Kuala Terengganun di Pejabat Defendan (MAIDAM) dan melalui iklan di akhbar kepada semua waris-waris kepada Wakaf Khas Zuriat Al-Marhum Tg.Nik Maimunah binti Sultan Zainal Abidin dan waris-waris Ikrar Wakaf Khas Tg. Chik Abdul Rahim bagi memanggil / memaklumkan kepada waris-waris Wakaf Khas Zuriat tersebut untuk menyertai Plaintif Pertama (Responden) dan Plaintif Kedua (Responden) di dalam kes Mal No.11200-099-2008 terhadap Dependan / MAIDAM sebagai mutawalli adalah diterima. Perintah tersebut adalah dibatalkan.



2. Semakan supaya memasukkan dan memanggil atau menamakan kesemua 292 dan 21 orang bukan waris-waris benefisiari Wakaf Khas Zuriat Al-Marhum Tg. Nik Maimunah binti Sultan Zainal Abidin dan kesemua 385 orang dan 7 orang bukan waris / benefisiari Wakaf Khas Zuriat
Al-Marhum Tg. Chik sebagai pihak-pihak adalah ditolak.



3. Semakan isu jika pihak Responden-responden gagal membawa keseluruhan kesemua waris-waris / benefisiari bersama-sama di dalam pendakwaan kes ini, sebagaimana yang telah dipersetujui oleh Responden ke atas Bantahan Awal Pemohon maka Pemohon memohon Perintah Mahkamah Yang Mulia ini supaya tuntutan mal No. 11200-099-0400 tahun 2008 oleh Responden / Plaintif terbatal dengan sendirinya adalah ditolak.



4. Semakan supaya kes tuntutan deklarasi perbicaraan Mal No. 11200-099-0400 tahun 2008 dibicarakan di hadapan Yang Arif Hakim Mahkamah Tinggi Kuala Terengganu yang berlainan adalah ditolak.



5. Perbicaraan Kes Mal No. 11200-099-0400 Tahun 2008 hendaklah diteruskan di hadapan Yang Arif Hakim yang sama.

Wakaf Chenderong : Pihak MAIDAM tidak bersetuju perbicaraan diteruskan dan mohon saman dibatalkan.


Kes tuntutan mencabar status hukum syarak konsesi tanah wakaf Chenderong melibatkan lebih 25,000 hektar, keluasannya hampir sama dengan bahagian pulau negeri Pulau Pinang, ditangguhkan sehingga akhir Januari 2011.

Bagi pihak waris yang hadir dalam perbicaraan melahirkan rasa kesal kepada pihak MAIDAM yang berterusan menghalang proses mahkamah berjalan dengan lancar sehingga kes ini tertangguh hampir 2 tahun.

Cik Hajjah Faridah peguam pihak MAIDAM telah memaklumkan mahkamah bahawa Dymm Sultan Terengganu secara tidak rasmi mengarahkan MAIDAM memohon agar kes ini dibicarakan secara tertutup dan ini mengejutkan pihak waris kerana ia akan menghalang kepentingan pihak waris dan awam mengetahui kedudukan kes dan proses perbicaraan kerana ia melibatkan hukum syarak yang perlu diketahui oleh seluruh umat Islam.

Selain Sultan Terengganu, Raja Perempuan Perlis dan

Tuanku Ampuan Besar N.Sembilan adalah pewaris bagi tanah wakaf ini.

Usaha pihak MAIDAM pada 12/7/2010 membuat permohonan menangguh perbicaraan atas alasan untuk mendapatkan pandangan dari segi hukum syarak dari beberapa orang pensyarah UIA juga telah menjadikan rasa was-was para waris makin meninggi kerana apakah selama ini segala urusan dan perjanjian tanah wakaf konsesi Chenderong tidak mendapat nasihat dan panduan dari pihak yang berkelayakan. Justeru itu ini membuktikan pihak MAIDAM telah gagal mengurus tadbir tanah wakaf ini mengikut hukum syarak dan adalah betul permohonan pihak plaintif untuk membuktikan hukum syarak telah dilanggar oleh pihak MAIDAM.

Para waris merasakan jika urusan tanah wakaf ini tidak dibuat berladaskan hukum syarak, segala hasil yang mereka terima setiap tahun boleh dipertikai halal dan haramnya, ini akan menjadi isu besar bagi masyarakat islam akibat kesilapan atau kelemahan pihak MAIDAM.

Begitu juga usaha pihak MAIDAM untuk menyingkirkan hakim dan plaintif pada perbicaraan tersebut juga telah menunjukan pihak MAIDAM tidak setuju dengan keputusan Mahkamah Rayuan pada 8/6/2010 yang memutuskan perbicaraan penuh perlu dilansungkan pada 25/7/2010 dan 26/7/2010 kerana segala tuntutan semakan pihak MAIDAM adalah ditolak.

Pihak MAIDAM juga memohon agar mahkamah membatalkan saman pihak Plaintif adalah satu usaha menghalang keadilan undang-undang ditegakan lebih-lebih lagi melibatkan hukum syarak.

Pihak plaintif sendiri telah memohon dalam mahkamah agar MAIDAM menyerahkan lapuran tahunan tanah wakaf Chenderong yang selama ini tidak pernah diserahkan kepada semua pewaris.

Pewaris berharap agar kes ini segera diselesaikan kerana ia melibat hukum syarak dan akan menjadi kes rujukan pada masa akan datang jika berlaku kes yang serupa. Kepentingan hukum syarak perlu dipertahankan serta memastikan sumber hasil wakaf ini dari sumber halal serta sahih disegi hukum islam.

Rata-rata pewaris yang hadir melahirkan rasa tidak puashati dengan tindakan MAIDAM menghalang penyelesaian dan proses undang-undang islam dilaksanakan dengan betul oleh pihak mahkamah dalam permohonan pihak plaintif sejak sekian lama. Bagi pewaris keputusan yang dibuat oleh hakim nanti menjadikan tanah wakaf chenderong diurus tadbir bertepatan dengan kehendak hukum syarak tanpa melahirkan perasaan was-was bahawa hasil yang diterima adalah halal ataupun haram disegi hukum islam.

Pewaris juga mendakwa pihak MAIDAM cuba menyembunyikan sesuatu kerana sejak 2 tahun lepas pewaris menunggu perbicaraan penuh berlansung, tapi setiap kali perbicaraan ingin bermula ada sehaja alasan dan halangan akan dilakukan oleh pihak peguam MAIDAM, Bagi pewaris jika perbicaraan penuh berlansung segala penghujahan dari peguam kedua-dua belah pihak akan membuka cerita sebenar apa yang berlaku dalam status pengurusan tanah wakaf ini dan mereka berharap perkara yang dituntut oleh Plaintif dapat diterima oleh hakim serta memberikan keputusan seadil-adilnya mengikut hukum syarak.

The Chenderong Concession Royal Grant

Seal of Sultan Zainal Abidin

This instrument in executed in the State of Terengganu Sunday, 2nd Muharam 1324.

Whereas we Sultan Zainal ‘Abidin Sovereign Ruler of the State of Trengganu and its territories have bestowed ceded and given possession of title to Tengku Ngah bin Tengku Abdul Rahim and his wife, Tengku Nik binti Zainal ‘Abidin the piece of land which is on the right side upstream of Sungai Cherol in Kemamam, province of Terengganu, as a gift and lawful cession and irrevocable to become the rightful possession of Tengku Ngah and Tengku Nik and their descendents perpetually, with specific boundary, i.e. downstream up to the Sungai Chenderong and continous into Sungai Burong following the boundary of Bundi and the boundary with the land of Sungai Sendok up to Sungai Rong Ketchil and upstream up to the meeting line with Pahang boundary, and on this side by the sea up to the bank of Sungai Cherol and the bank of Sungai Traju on the right upstream of the two rivers, and on the side by the land up to the left bank upstream Sungai Kemaman.

Whereas Tengku Ngah and Tengku Nik are hereby to accept possession of the said land and Tengku Ngah and Tengku Nik and their descendants are hereby to have power to deal with the said land its hills and rivers within the said boundary as the rightful owners, fully and effectually, forever without prohibition or dispute to them and free of government land rent as that place has become the rightful and disputed possession of Tengku Ngah and Tengku Nik: and it is also empowering a person to accept a surrender from Tengku Ngah and Tengku Nik or their next-of-kins, executors/administrators, representatives, attorneys and partners which enables him to have control over the said land in accordance with what is permitted and allowed by Tengku Ngah and Tengku Nik.

Whereas the government duty on things taken out of the place has been fixed, i-e- all kinds of mining output from the land such as tin ore, gold, silver or previous stones etc. The duty payable is calculated at 5% and from plants rubber, sago, cotton 1%, chilly/pepper, gambier, coconut and other plants 2 ½%, and from jungle produce such as timber, rattan etc. the duty shall be 5%, whenever they are taken out of the place and payable in kind from those things taken out or by their value.

All things taken into the places – opium one box/case the duty shall be $120/- i.e. one lum $3/- and Chinese and Javanese tobacco and other kinds of things all shall confirm to the law and regulation of the state of Trengganu as laid down by the Government from time to time. Also gambling and liquer both of them belong to the Government and the revenue therefrom shall be collected at any time deemed expedient by the Government except iron/steel equipment, or household goods/tools or machinery or things brought in by Government employees or labourers into place shall be exempted from duty.

In witness whereof we have herein to set the Government seal of Sultan Zainal ‘Abidin and the seal of Yang Dipertuan Muda hereinbelow.

The Chenderong Concession Wakaf Deal

Hereinafter be it known by all those present and others that I, Tengku Nik Maimunah Al-Hajjah binti Al-Marhum Sultan Zainal Abidin and my husband, Tengku Ngah Omar bin Tengku Abdul Rahim bearing the title of (Tengku Seri Utama Raja) have been bestowed by His Majesty, my late father Al-Sultan Zainal Abidin ibni Al-Marhum Sultan Ahmad, Ruler and Ruling Government for the State of Trengganu and all its territories and dependencies, with a piece of land in the District of Kemaman, Mukim Tebak, in the State of Terengganu, known by the name of Chenderong Concession as contained in a letter affixed thereto by the seal of the seal of the Royal Grant dated 22nd day of Muharam 1324 Hijrah, a certified photostat copy of which is attached herewith. The grant is equal share between me and my husband. On the death of my husband ¼ of his share became my rightful share in accordance with the Islamic Law and therefore with my original share of 4/8 added 1/8 makes a total of 5/8 share of Chenderong Concession as my rightful share and that of my direct descendants and heir in perpetuity. With effect from the date of this letter, be it known that I, the undersigned Tengku Nik Maimunah Al-Hajjah binti Al-Marhum Sultan Zainal Abidin, in sound mind and good physical health, willfully and without force or pressure from anybody whatsoever, declare, affirm and witness that I endow in perpetuity all the right, interests and income derived from 5/8 (five eight) share of the said Chenderong Concession to those persons stated here-under in accordance with the rates of distribution that I have stipulated for each person stated in pages 2 to 5.

Be it known in respect of the 5/8ths share in the Chenderong Concession of which I am the owner, I have created a lease I favour of Cinde Development Limited whose office is situated at No.9, Hale Street, Ipoh, Perak as appeared in the agreement to lease and lease agreement date 2th January 1961 for a term of 999 years.

1. To my younger brother His Highness Al-Sultan Ismail Nasiruddin Shah, D.M.N. Ibni Al-Sultan Zainal Abidin is granted 16/144 share which will remain his and subsequent to him on his death his children will be entitled to receive equal number of the shares among them from that share and thereafter on their death their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them, his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

2. To my elder sister, Tengku Ngah Aishah Al-Hajjah binti Al-Sultan Zainal Abidin is granted 24/144 share which will remain hers and subsequent to her (on her death) her children will be entitled to receive equal number of the shares among them out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them, his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

3. To my younger sister, Tengku Wok Aminah binti Al-Sultan Zainal Abidin (Tengku Kesuma Puri) is granted 7/144 share which will remain hers and subsequent to her (on her death) her children will be entitled to receive equal number of the shares among them out of what that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them, his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.


4. To my younger brother, Tengku Ahmad ibni Al-Sultan Zainal Abidin is granted 16/144 share which will remain his and subsequent to his (on his death) his children will be entitled to receive equal number of the shares among them out of what that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them, his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

5. To my younger brother, Tengku Besar Mahmud ibni Al-Sultan Zainal Abidin (Tengku Seri Utama Raja) is granted 16/144 share which will remain his and subsequent to his (on his death) his children will be entitled to receive equal number of the shares among them out of what that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them, his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

6. Each of my following nephews and nieces respectively gets an equal share out of 8/144 share:-

1. Tengku Ali ibni Al-Marhum Sultan Sulaiman
2. Tengku Abdul Aziz ibni Al-Marhum Sultan Sulaiman
3. Tengku Abdul Rashid ibni Al-Marhum Sultan Sulaiman
4. Tengku Abdul Rahman ibni Al-Marhum Sultan Sulaiman
5. Tengku Asma binti Al-Marhum Sultan Sulaiman
6. Tengku Wok ‘Atikah binti Al-Marhum Sultan Sulaiman
7. Tengku Mariah binti Al-Marhum Sultan Sulaiman
8. Tengku Azizah binti Al-Marhum Sultan Sulaiman

And such share will remain his/hers and subsequent to him/her (on his/her death), his/hers issues will be entitled to receive equal number of shares out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his/hers respective share will be returned to the poor and destitute persons among Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

7. To my niece, Tengku Tengah binti ex-Sultan Muhammad is granted 2/144 share which will remain hers and subsequent to her (on her death) her issues will be entitled to receive among them equal number of the shares out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

8. To my niece, Tengku Puteri binti Tengku Muda is granted 2/144 share which will remain hers and subsequent to her (on her death) her issues will be entitled to receive among them equal number of the shares out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

9. To my nephew, Tengku Embung binti Tengku Muda is granted 2/144 share which will remain his and subsequent to him (on his death), his issues will be entitled to receive among them equal number of the shares out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

10. To my grand nephew, Tengku Embung Abdullah binti Tengku Hitam Majid is granted 2/144 share which will remain his and subsequent to him (on his death), his issues will be entitled to receive among them equal number of the shares out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

11. To my great grand nephew, Tengku Ismail binti Tengku Abdul Aziz is granted 2/144 share which will remain his and subsequent to him (on his death), his issues will be entitled to receive among them equal number of the shares out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

12. To my niece, Tengku Teh binti Khazaki is granted 1/144 share which will remain hers and subsequent to her (on her death) her issues will be entitled to receive among them equal number of the shares out of that share and thereafter (on their death) their shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

13. To my nephew-in-law Tengku Su bin Tengku Hussein is granted 3/144 share which will be his during his life time and on his death, his share will be endowed to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

14. To Haji Embong Yusof bin Ibrahim is granted 3/144 share which will be his during his life time and on his death, his share will be endowed to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

15. To my adopted daughter, Hajjah Mahani binti Sulaiman is granted 4/144 share in perpetuity until her direct descendants have receive their equal shares out of that share and thereafter have receive (on the death of the descendants) the shares will be distributed to their respective descendants and on cessation of direct descent of any one of them his respective share will be returned to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

16. To my adopted daughter, Hajjah Jawahir binti Abdullah is granted 2/144 share in perpetuity until grand-children and if there are no grand-children the share will be endowed to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

17. To my adopted daughter, Hajjah Mariam binti Muhammad is granted 2/144 share which will remain so until it is inherited by her children and if there are no children her share will be endowed to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

18. To my adopted daughter, Hajjah Mek Long binti Abdullah is granted 2/144 share during her life-time and on her death her share will be endowed to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

19. To Enche’ Embong bin Abu Bakar is granted 1/144 share during his life-time and on his death, his share will be endowed to the poor and destitute persons among the Muslims, under the management and administration of the Islamic Affairs Department, Trengganu.

20. Other than the share that I have allotted above, i.e. the remaining shares shall be utilized by the Inspector in-charge of Endowment to meet expenses incurred in connection with the purpose stated below:-

4/144 share is allotted for the welfare of my soul namely by giving away in alms every month indefinitely to those persons who read the Quran at my tomb, and by holding feast on the occasion saying prayers for my soul at least once a week and during my life-time this shall be expended for the welfare of the poor and destitute Muslims under the management of the Inspector.

21. 2/144 share is allotted for assistance to teachers teaching Islamic lessons and those persons (from all races) who recite the Quran at the Mosque in Mekah and Madinah.

22. 2/144 share is allotted under management of the Islamic Affairs Department, Terengganu, to students wishing to perform pilgrimage but short of funds.

23. 2/144 share is allotted as assistance to children of poor Muslims studying at Sekolah Zainal Abidin and Sekolah Khairiah and other religious schools in the State of Trengganu. If there are no such students in both the schools, the share shall be held under the charge and management of the Islamic Affairs Department, Trengganu.

24. 2/144 share shall be allotted for persons wishing to study religious in Mekah and Madinah.

25. 2/144 share shall is allotted for assistance to Muslims orphan children in the State of Terengganu who wish to continue their religious studies abroad or locally and such share will be under the charge and management of the Islamic Affairs Department, Trengganu.

26. 4/144 share shall be allotted as assistance to any mosque and Surau in the State of Trengganu to meet expenses on the purchases of furniture’s and fittings for, and repair to, such mosque and other necessity thereto, and the share shall be under the charge of the Islamic Affairs Department, Trengganu.

27. 3/144 share shall be allotted for assistance to those studying in mosques in Mekah and Madinah.

28. 1/144 share shall be allotted as grant to the public for breaking fast at Abidin Mosque, Terengganu and such share shall be under the charge of the Islamic Affairs Department, Trengganu.

As long as I am living as the endower I shall be the Inspector in respect of the above Endowment and on my death and thereafter the powers of the Inspector as above shall be transferred to ……………direct descendant of Al-Marhum Al-Sultan Zainal Abidin or any person appointed or approved by…………. or such person as approved by the majority of persons having the right in this endowment and who are the direct descendants of Sultan Zainal Abidin. For the purpose of receiving revenue from endowment in respect of those entitled to it by virtue of the shares allotted to them respectively as stated above and in order to decide on any consideration with any firm or company or individual persons in respect of lease or mortgage etc., of the land known as Chenderong Concession, it shall be provided in the endowment that before the shares as stated above are distributed, there shall be withdraw 7/144 share of all the revenue derived from that part of Chenderong Concession that is endowed, for the benefit of the Inspector and in order to meet the necessary expenses incurred in the management of this Endowment.

Every action taken by me in relation to the Chenderong Concession prior to the signing of this Endowment letter shall be treated as valid and must be honoured by all concerned in this endowment and all revenues and interest taken by me shall not question and claimed by signing this endowment shall not be question and claimed by anyone and my revenue and interest derived or received after affixing my signature on this letter shall be dealt with I accordance with the provision laid down in this endowment.

My message is that all the provisions contained in this Endowment shall be complied with in every detail by all concerned and I pray to Allah for the befallen our curse and anger upon those attempting or agreeing to amend, modify or revoke this Endowment and I make Allah as the most distinguished witness.

Tangguh bicara kes saman Maidam


KUALA TERENGGANU – Mahkamah Tinggi Syariah di sini semalam menangguhkan perbicaraan kes tuntutan saman waris tanah wakaf Chenderong terhadap Majlis Agama Islam dan Adat Melayu Terengganu (Maidam) pada 23 dan 24 Januari tahun depan.

Hakim Shaikh Ahmad Ismail membuat keputusan itu setelah Maidam selaku defendan memberi alasan belum bersedia mengikuti prosiding perbicaraan kes berkenaan yang difailkan dua wakil waris pada Disember 2008.

Pada prosiding itu, defendan yang diwakili Faridah Yusof juga memohon ex-parte agar plaintif, Tengku Hidayah Tengku Habib, Tengku Zainul Akmal Tengku Besar Mahmud dan peguam mereka tidak bercakap kepada media mengenai kes itu.

Maidam turut memohon mahkamah melarang semua media melaporkan perjalanan prosiding kes itu sehingga ia selesai dengan menetapkan perbicaraan tertutup yang hanya dihadiri defendan dan plaintif bersama peguam masing-masing.

Defendan mengemukakan ex-parte itu dengan alasan plaintif menghina dan mengaibkan pihaknya melalui laporan media sedangkan kes itu belum selesai serta masih berjalan.

Bagaimanapun, peguam plaintif, Kamar Ainiah Kamaruzzaman membantah kerana katanya media mempunyai peranan dan tanggungjawab dan jika mereka membuat laporan salah, defendan boleh memfailkan saman.

Malah katanya, apa yang siarkan media adalah perkara benar mengikut fakta kes dan selama 25 tahun dalam bidang guaman, beliau tahu apa yang boleh dan tidak boleh dinyatakan kepada media.

Dalam saman yang dikemukakan Tengku Zainal Akmal dan Tengku Hidayah, mereka yang mewakili 460 keluarga pewaris tanah wakaf mendakwa defendan gagal menguruskan pajakan hartanah seluas 25,379.23 hektar itu, menyebabkan ada waris hanya memperoleh pendapatan RM3 setahun.

Mereka juga memohon perintah mahkamah membatalkan semua perjanjian pajakan, selain menuntut Maidam menguruskan harta wakaf di bawah satu unit khas dianggotai wakil waris tanah wakaf, atau membenarkan waris menguruskan sendiri harta.

KUALA TERENGGANU, July 25 — A milestone legal dispute over 25,000 hectares — approximately the size of Penang island — of Terengganu “wakaf” (endowment) land was today postponed to January 2011.

The Syariah High Court here made the decision after lawyers representing the defendants, the Terengganu Islamic and Malay Custom Council, pleaded inability to continue with the proceedings due to a lack of preparations .

The case had initially been scheduled to heard for two days, beginning today.

Additionally, the court had also taken into account an ex-parte application from Faridah Yusof, a defence lawyer, seeking to bar media coverage of the proceedings along with a gag order preventing the plaintiffs and their representatives from speaking on the events of the trial.

Presiding Syarie Judge Shaikh Ahmad Ismail also heard an inter-part application, again from the defence, for the case to be conducted behind closed doors.

The landmark case has drawn public scrutiny as it involves the single largest tract of endowment land in the country.

The piece of land in Chendrong was awarded by the late Terengganu ruler, Sultan Zainal Abidin III, to his daughter Tengku Nik Maimunah and her husband Tengku Ngah Omar Abdul Rahim in March 1906, and was later turned into wakaf land, which under Islamic law can only be used for religious or charitable purposes.

The dispute started after some descendents of Tengku Ngah Omar became unhappy with the management of the land by the Terengganu Islamic and Malay Custom Council, and the annual payout.

The case was filed in December 2008 and, after several objections and attempts to seek an out-of-court settlement, was finally heard today.

Judge Shaikh Ahmad decided to allow the ex-parte application to bar the media from covering the case after receiving and passing the draft order from the defendant.

The application of Kamar Ainiah to change the ex-parte injunction to an inter-parte one was rejected.

After the hearing Faridah said that the media cannot cover the case until it is concluded and can get details of the case once published in the Malayan Law Journal.

However, she was reluctant to reveal the contents of the ex-parte application.

Kamar Ainiah however insisted that the media has a responsibility to play as the case is one of public interest. She referred the on-going sodomy trial of Datuk Seri Anwar Ibrahim where the media reporting has not been restricted.

When counsel Faridah said that July 23 report in The Malaysian Insider was detrimental to the defendants, Kamar Ainiah said that the media has access statements of demand which are public documents.

Faridah pointed out the picture of Yang di-Pertuan Agong was used and it was suggested that he was one of the beneficiaries. Kamar Ainiah is in fact one of the beneficiaries.

Lawyers for the defendants asked for the case to be thrown out as the two plaintiffs do not represent all the beneficiaries and also ask for the judge to be replaced.

Kamar Ainiah countered that the application would amount to contempt of court as it would mean refusing to follow the Appeals Court order.

She noted that on June 8 the Appeals Court rejected a similar application.

The judge said he was reluctant to carry on with the proceedings in a situation that is not calm and asked the defendants when they would be ready to continue with the proceedings.

“I am ready at any time. If there are lawyers who are not ready, what can I do,” he said.

The judge then fixed January 23 and 24 for the trial to continue.

Kes tanah wakaf Chenderong ditangguh, defendan mahu kes didengar tertutup

KUALA TERENGGANU, 25 Julai — Kes tuntutan mencabar status konsesi tanah wakaf Chenderong melibatkan lebih 25,000 hektar, keluasannya hampir sama dengan bahagian pulau negeri Pulau Pinang, ditangguhkan sehingga akhir Januari 2011.

Mahkamah Tinggi Syariah Kuala Terengganu hari ini membuat keputusan atas alasan pihak peguam defendan dan defendan iaitu Majlis Agama Islam dan Adat Melayu Terengganu belum bersedia untuk mengikuti prosiding.

Prosiding sepatutnya berlangsung hari ini dan esok.

Selain itu, mahkamah memutuskan demikian ekoran permohonan ex-parte peguam defendan Faridah Yusof agar media dilarang menyiarkan prosiding mahkamah manakala plaintif dan peguam mereka juga dilarang bercakap kepada media mengenai perjalanan kes.

Mahkamah juga akan mendengar permohonan inter-parte peguam defendan agar kes ini didengar secara tertutup.

Perbicaraan ini menarik perhatian kerana iadilihat sebagai kes pertama melibatkan tanah wakaf tunggal terluas di negara ini iaitu 25,379.23 hektar.

Tanah itu yang dikurniakan oleh Sultan Terengganu Almarhum Sultan Zainal Abidin III kepada anakanda perempuan Tengku Nik Maimunah dan suaminya, Tengku Ngah Omar Abdul Rahim pada Mac 1906, dijadikan tanah wakaf pada 1961.

Tuntutan kes difailkan pada Disember 2008 dan selepas beberapa peringkat bantahan awal.

Hakim Shaikh Ahmad memutuskan beliau akan membenarkan permohonan ex-parte untuk melarang media melaporkan kes ini selepas menerima dan meluluskan draf perintah daripada defendan kemudian.

Mahkamah dimaklumkan bahawa pihak defendan bersedia untuk prosiding apabila perintah ex-parte itu dikeluarkan.

Bagaimanapun ia dibantah oleh pasukan plaintif.

Faridah memberitahu mahkamah beliau akan menyerahkan draf dalam waktu terdekat, dipercayai esok untuk diteliti mahkamah.

Permohonan Kamar Ainiah untuk hakim menukar permohonan injuksi ex-parte menjadi inter-parte ditolak.

Faridah yang ditemui selepas sidang mahkamah berkata media tidak boleh membuat liputan sehingga kes selesai.

Katanya, media boleh mendapatkan butiran kes apabila keputusan diterbitkan oleh Malayan Law Journal.

Bagaimanapun beliau enggan mendedahkan kandungan ex-parte.

“Media ada tugas untuk melaporkan prosiding kerana ia membabitkan kepentingan awam,” kata Kamar Ainiah.

Kamar Ainiah memberitahu mahkamah bahawa media patut dibenarkan untuk membuat liputan dan jika ada pelanggaran pihak defendan boleh mengambil tindakan sivil terhadap mereka.

“Termasuk saya, saya sudah 25 tahun berkhidmat sebagai peguam, ambil tindakan jika saya langgar kod etika guaman,” katanya.

Sambil merujuk kepada kes liwat Datuk Seri Anwar Ibrahim semasa, Kamar Ainiah berkata media melaporkan dengan panjang lebar prosiding tanpa sekatan mahkamah.

Mahkamah akan mengambil tindakan hanya jika ada pelanggaran keterlaluan.

Apabila Faridah membangkitkan bahawa laporan The Malaysian Insider mengenai kes ini pada 23 Julai lalu telah menggugat dan mengaibkan defendan, Kamar Ainiah berkata media bebas untuk akses kepada mana-mana penyata tuntutan dan jawapan yang merupakan dokumen awam.

Faridah mendakwa The Malaysian Insider telah memaparkan wajah Yang di-Pertuan Agong dengan memetik baginda sebagai salah seorang waris.

Mengenai isu ini, Kamar Ainiah berkata baginda hanya seorang waris dalam tanah wakaf Chenderong dan ia juga satu fakta kes.

Peguam defendan juga meminta kes ini dibuang atas alasan dua plaintif tidak mewakili semua waris dan meminta Hakim Shaikh Ahmad digantikan dengan hakim lain.

Bagaimanapun Kamar Ainiah membantah permohonan itu atas alasan ia tindakan menghina mahkamah kerana enggan mematuhi perintah Mahkamah Rayuan.

Kata beliau, Mahkamah Rayuan pada 8 Jun lalu telah menolak permohonan yang serupa, di mana mahkamah juga telah mengarahkan perbicaraan diteruskan di hadapan hakim yang sama.

Hakim kes berkata beliau tidak mahu meneruskan prosiding hari ini dalam suasana tidak tenang dan bertanya kepada defendan bila mereka bersedia untuk menghadapi prosiding.

Kemudian hakim menetapkan 23 dan 24 Januari depan sebagai tarikh baru perbicaraan.

“Saya bersedia bila-bila masa, kalau ada peguam yang tidak bersedia, apa saya boleh buat,” kata hakim.

Kamar Ainiah berulang kali menekankan bahawa pihaknya bersedia untuk prosiding hari ini dengan semua kertas kusa telah sedia ada.

“Kalau defendan tak bersedia itu hal mereka, mahkamah kena berlaku adil dengan meneruskan prosiding hari ini,” katanya.

Faridah juga meminta mahkamah tidak mengadakan prosiding pada hari Ahad atas alasan jika media membuat laporan ‘menjejaskan’ kepentingan defendan pada mana-mana hari Jumaat atau Sabtu, pihaknya tidak boleh melakukan apa-apa tindakan susulan sebelum hari perbicaraan.

Kes ini dibawa selepas pewaris konsesi tanah wakaf Chenderong ini, yang terletak di sempadan Kemaman dan Kuantan, meluahkan rasa kesal terhadap cara Majlis Agama Islam dan Adat Melayu Terengganu menguruskan tanah tersebut.

Jumlah pewaris dianggarkan 462 orang, yang hampir kesemuanya merupakan anggota kerabat diraja negeri Terengganu.

Kira-kira 70 waris hadir untuk mendengar prosiding hari ini dan mereka kelihatan kecewa apabila kes ditangguhkan.

Beberapa waris kelihatan mengeluh, antaranya ada yang berkata “tangguh lagi... tahun depan pula”, apabila mendengar keputusan hakim menangguhkan perbicaraan.

Salah seorang pewaris tanah wakaf ini ialah Yang di-Pertuan Agong Sultan Mizan Zainal Abidin yang juga Sultan Terengganu.

Plaintif memohon mahkamah membuat deklarasi bahawa kesemua transaksi berhubung tanah wakaf Chenderong oleh Majlis Agama Islam dan Adat Melayu Terengganu adalah tidak sah di bawah hukum syarak.

Kes ini kali pertama difailkan pada Disember 2008 berdasarkan Seksyen 18(1) Enakmen Tatacara Mal Mahkamah Syariah (Terengganu) 2001.

Fatwa Chenderong Konsesyen

Keputusan:

Setelah mendengar taklimat daripada pihak Majlis Agama Islam dan Adat Melayu Terengganu tentang latar belakang Chenderong Konsesyen dan menghalusi dokumen berkaitan serta persoalan-persoalan mengenainya, mesyuarat bersetuju mengambil keputusan seperti berikut :

i. Taraf wakaf Chenderong Konsesyen mengandungi wakaf khas, wakaf zuriat dan juga wasiat.
ii. Tanah wakaf tidak boleh dijualbeli atau diubah statusnya daripada syarat yang telah dibuat oleh pewakaf, tetapi tanah tersebut termasuk hasilnya boleh dipajak dan diSUBLISTkan.
iii. DYMM Al-Sultan sekarang adalah berhak menerima bahagian daripada tanah wakaf Chenderong Konsesyen kerana baginda adalah pewaris daripada keturunan baginda Al-Marhum Al-Sultan Ismail Nasaruddin Shah Ibni Al-Marhum Sultan Zainal Abidin.
iv. Baginda juga sebagai pemegang amanah (nazir) ke atas tanah tersebut yang dikurniakan bahagiannya sebanyak 7/144. Dengan itu perolehan baginda DYMM Al-Sultan daripadanya adalah sah dari segi peraturan dan wasiat pewakaf.

Selain daripada itu Mesyuarat juga bersetuju dengan pembahagian yang dilakukan oleh pihak MAIDAM kepada waris-waris Al-Marhumah Engku Zaharah (anak kepada Al-Marhumah Tengku Ngah Aisyah ) binti Engku Sulong, atas dasar wakaf zuriat sebagaimana ikrar wakaf Tengku Nik Maimunah sendiri iaitu :

' Kepada Paduka kekanda saya Tengku Ngah Aisyah Al-Hajjah binti Al-Marhum Al-Sultan Zainal Abidin sebanyak 24/144 bahagian dan berkekalanlah baginya, dan kemudian daripadanya berhaklah anak-anaknya mendapat daripada bahagian itu dengan sama banyak, dan kemudian kembalilah kepada zuriat keturunan masing-masing, dan manakala putus zuriat salah seorang daripada mereka maka kembalilah bahagiannya itu kepada fakir miskin Islam di bawah kelolaan dan pentadbiran Pejabat Hal Ehwal Agama Islam Terengganu'.

Ia dilihat sebagai kes pertama melibatkan tanah wakaf tunggal terluas di negara ini iaitu 25,379.23 hektar.

Tanah itu yang dikurniakan oleh Sultan Terengganu Almarhum Sultan Zainal Abidin III kepada anakanda perempuan Tengku Nik Maimunah dan suaminya, Tengku Ngah Omar Abdul Rahim pada Mac 1906, dijadikan tanah wakaf pada 1961.

Tuntutan kes difailkan pada Disember 2008 dan selepas beberapa peringkat bantahan dan usaha untuk diselesaikan di luar mahkamah, ia akan didengar selama dua hari mulai Ahad ini.

“Perbicaraan akan diadakan pada Ahad dan Isnin ini selepas ia difailkan Disember 2008,” kata peguam Kamar Ainiah Kamaruzaman yang mewakili plaintif ketika ditemui The Malaysian Insider di sini.

Kes ini dibawa selepas pewaris konsesi tanah wakaf Chenderong ini, yang terletak di sempadan Kemaman dan Kuantan, meluahkan rasa kesal terhadap cara Majlis Agama Islam dan Adat Melayu Terengganu menguruskan tanah tersebut.

Jumlah pewaris dianggarkan 462 orang, yang hampir kesemuanya merupakan anggota kerabat diraja negeri Terengganu.

Salah seorang pewaris termasuklah Yang di-Pertuan Agong Sultan Mizan Zainal Abidin yang juga Sultan Terengganu.

Berdasarkan maklumat yang diterima daripada Kamar Ainiah, dua daripada waris mengemukakan tuntutan saman mendakwa pengurusan pajakan tanah wakaf milik mereka kurang sistematik menyebabkan hasil diperoleh sedikit selain kerugian berganda sehingga ada waris hanya menerima pendapatan RM3 setahun.

Kamar Ainiah juga memberitahu, dalam saman yang dikemukakan Tengku Zainal Akmal Tengku Besar Mahmud dan Tengku Hidayah Tengku Habib terhadap Majlis Agama Islam dan Adat Melayu Terengganu, mereka mendakwa pihak berkenaan gagal menguruskan pajakan hartanah itu hingga menyebabkan ada waris hanya memperoleh pendapatan RM3 setahun.

Kata beliau, plainitif yang turut mewakili 460 ketua keluarga pewaris tanah wakaf itu, antara lain menuntut ganti rugi hasil pajakan tanah.

Kamar Ainiah berkata, pewaris berpendapat bahawa tanah wakaf itu tidak harus diserahkan kepada pihak lain untuk tujuan pajakan.

Selain tempoh pajakan yang begitu lama, penglibatan pihak-pihak lain, syarikat lain juga menjadi persoalan, kata beliau lagi.

Mereka juga memohon perintah mahkamah membatalkan semua perjanjian pajakan, selain menuntut Majlis Agama Islam dan Adat Melayu Terengganu menguruskan harta wakaf di bawah satu unit khas dianggotai wakil waris tanah wakaf, atau membenarkan waris menguruskan sendiri harta.

Jurucakap waris terbabit, Tengku Mohammed Zainal Abidin Petra Tengku Besar Mahmud sebelum ini pernah berkata, beliau membuat tuntutan di mahkamah agar perjanjian pajakan dan serah hak dibatalkan kerana semasa perjanjian dibuat, konsesi tanah wakaf adalah bertaraf tanah wakaf.

“Kita juga menuntut supaya hak menguruskan harta wakaf ini dilaksanakan sepenuhnya oleh Majlis Agama Islam dan Adat Melayu Terengganu di bawah satu unit khas bersama wakil waris atau waris dibenarkan mengurus sendiri melalui penubuhan sebuah syarikat.

“Tuntutan mahkamah ini dilihat sebagai satu tindakan yang positif bertujuan menjaga hak dan kepentingan pewaris wakaf ini daripada terus dikhianati serta mengalami kerugian,” kata Tengku Mohammed Zainal Abidin Petra sebelum ini.

Malah menurut Tengku Mohammed Zainal Abidin Petra, jika dibandingkan nilai semasa kayu balak dan kelapa sawit, jumlah diterima tidak masuk akal.

Keluasan tanah wakaf Chenderong yang diiktiraf Majlis Agama Islam dan Adat Melayu Terengganu seluas 25,379.569 hektar dan berdasarkan perjanjian pajakan, hasil diperoleh daripada kayu balak, perlombongan, sewa tanah dan tanaman.

Ketika ditanya mengenai latar belakang maklumat kes ini, Kamar Ainiah berkata urusan memajukan tanah ini kini terletak di bawah tanggungjawab syarikat Tis ‘Ata ‘Ashar Sdn Bhd (TAA) selaku pemajak utama keseluruhan.

TAA, yang dibentuk pada 1985, didakwa bertindak “menjual” dan menyerahkan segala hak serta kepentingan pajakan dan pengurusan tanah itu kepada SPPT Development Sdn Bhd (SPPT) tanpa mengenakan bayaran kepada pihak wakaf.

Maklumat yang difailkan di mahkamah juga menunjukkan syarikat itu juga menyerahkan hak atau memajak kepada beberapap pihak lain iaitu TDM Capital Sdn Bhd, Manyvest Holdings, Risda atau Espek, Anglo Eastern manakala SPPT Development pula menyerahkan kepada Mudari Holdings dan Worldwide Plantation.

Waris-waris tanah wakaf itu mempersoalkan bagaimana Majlis Agama Islam dan Adat Melayu Terengganu selaku pentadbir tanah wakaf boleh membiarkan perkara ini berlaku tanpa mengenakan syarat yang lebih menguntungkan wakaf.

Tengku Mohammed Zainal Abidin Petra berkata, pihaknya mempersoalkan alasan Majlis Agama Islam dan Adat Melayu Terengganu atau TAA tidak memilih menguruskan harta wakaf itu dan jika ia diusahakan sendiri, pendapatan dihasilkan dianggarkan RM700 juta dengan nilai keuntungan RM365 juta.

Pihaknya turut mempertikai pemilikan saham Majlis Agama Islam dan Adat Melayu Terengganu dalam pemajak utama, TAA sedangkan pada masa sama ia adalah pentadbir tunggal wakaf dan ia jelas ada percanggahan kepentingan.

Majlis Agama Islam dan Adat Melayu Terengganu mempunyai 17 peratus saham dalam TAA.

Majlis Agama Islam dan Adat Melayu Terengganu pernah mengeluarkan fatwa bahawa konsesi tanah wakaf Chenderong mengandungi wakaf khas, wakaf zuriat dan juga wasiat, dan ia tidak boleh dijual beli atau diubah statusnya daripada syarat yang telah dibuat oleh pewakaf, tetapi tanah tersebut termasuk hasilnya boleh dipajak dan disubliskan.

Pada awalnya menurut Kamar Ainiah, lima bulan sebelum menjadikan tanah miliknya sebagai tanah wakaf zuriat, Tengku Nik Maimunah dan Tengku Chik, yang merupakan adik kepada Tengku Ngah Omar, telah memajakkan tanah mereka kepada Cindee Development untuk tempoh selam 999 tahun.

Bagaimanapun kandungan perjanjian dipinda untuk mengurangkan kepada pajakan 99 tahun pada 31 Disember 1985.

Ketika itu urusan mentadbir tanah berkenaan terletak di bawah penyeliaan Pesuruhjaya Majlis Hal Ehwal Islam Terengganu, kini Majlis Agama Islam dan Adat Melayu Terengganu.

Cindee Development pula telah memajakkan 21,170 hektar kepada TAA pada Disember 1986 dan 2,000 hektar kepada Tengku Seri Paduka Raja, 1,960.8 hektar kepada Chenderong Oil Palms manakala Tengku Seri Paduka Raja pula kemudian telah memajakkan 1,848 hektar daripada bahagaiannya kepada National Land Finance Coop.

According to Kamar Ainiah, two of the descendents claimed that the mismanagement of the land has resulted in low returns, with some of the beneficiaries receiving only RM3 every year.

Beneficiaries of wakaf land are allowed to derive income from a small part of the property.

Kamar Ainiah said that in the application made by Tengku Zainal Akmal Tengku Besar and Tengku Hidayah Tengku Habib against the state Islamic council, some 460 families were also seeking compensation for loss of income due to unfair land lease deals.

She added that the family members were of the opinion that the land should not have been leased.

They are also seeking a declaration that all leases are null and void, and demanded that the Islamic council form a special body comprising the family members to jointly administrate the property.

Kamar Ainiah said Tis ‘Ata ‘Ashar Sdn Bhd (TAA), a company formed in 1985, is the principal leaseholder and that it had surrendered some parts of the land to be developed by Development Sdn Bhd (SPPT) without compensating the trustees.

According to documents filed in court, the company had also leased some parts of the land to TDM Capital Sdn Bhd, Manyvest Holdings, Risda or Espek, and Anglo Eastern, while SPPT Development had given its land to Mudari Holdings and Worldwide Plantation.

The descendents of Tengku Nik Maimunah have questioned why the Islamic council, as the administrator of the land, did not impose any condition to benefit the trustees.

One of the trustees, Tengku Mohammed Zainal Abidin Petra, had said that the land can potentially generate revenues of up to RM700 million with a profit of RM365 million, if the Islamic council or TAA had chosen to manage the land by itself.

The family also claimed that the council’s ownership of 17 per cent of TAA shares had raised the question of conflict of interest.

The spokesperson for the royal heirs, Tengku Mohammed Zainal Abidin Petra Tengku Besar Mahmud, has mentioned previously that he had made the claims in court to ensure that the lease agreements and ownership entitlements to be annulled, because when the agreements were made, the concession status was meant for religious purposes.

“We would also like to demand that the management of this property [be] implemented by the Majlis Agama Islam and Adat Melayu Terengganu, under one unit together with the heirs, or that the heirs manage this property themselves through the formation of a private company.

“The court claim is seen as a positive action, to protect the rights and interests of the heirs,” said Tengku Mohammed Zainal Abidin Petra.

He also noted that if one were to compare the current value of timber and palm oil, the revenue received from the land was an insult.

The Terengganu Islamic council had issued a fatwa that there are three categories of land in the Chenderong Concession — special wakaf, inheritable wakaf, and willed land.

The land cannot be sold or have its usage condition changed, but can be leased and subleased.

According to Kamar Ainiah, five months before turning their land into inheritable wakaf, Tengku Nik Maimunah and Tengku Chik, who is a brother of Tengku Ngah Omar, had leased their land to Chindee Development for 999 years.

However, the lease was shortened to 99 years on December 31, 1985.

The land was then administrated by the Commissioner of Terengganu Islamic Affairs Council, now known as Terengganu Islamic and Malay Customs Council.

Cindee Development had then leased 21,170 hectares to TAA in December 1986, 2,000 hectares to Tengku Seri Paduka Raja, and 1,960.8 hectares to Chenderong Oil Palms, while Tengku Seri Paduka Raja leased 1,848 of the land to the National Land Finance Coop.

KUALA TERENGGANU - Kira-kira 500 waris tanah wakaf Chenderong Concession, di Kemaman meluahkan rasa kesal terhadap cara Majlis Agama Islam dan Adat Melayu Terengganu (Maidam) menguruskan tanah tersebut.

Mereka mendakwa, pengurusan pajakan tanah wakaf milik mereka kurang sistematik menyebabkan hasil diperoleh sedikit selain kerugian berganda sehingga ada waris menerima pendapatan RM3 setahun.

Wakil pewaris Chenderong Con-cession, Tengku Mohammed Zainal Abidin Petra Tengku Besar Mahmud berkata, jika dibandingkan nilai semasa kayu balak dan kelapa sawit, jumlah diterima tidak masuk akal.

Menurutnya, keluasan tanah Chenderong Concession yang diiktiraf Maidam seluas 63,448.923 ekar dan berdasarkan perjanjian pajakan, hasil diperoleh daripada kayu balak, perlombongan, sewa tanah dan tanaman.

“Urusan memajukan tanah ini di bawah tanggungjawab Syarikat Tis ‘Ata ‘Ashae Sdn Bhd (TAA) selaku pemajak utama keseluruhan Chenderong Concession, tapi harapan untuk melihat tanah wakaf tersebut dimajukan dan dijaga dengan baik hancur.

“TAA bertindak ‘menjual’ dan menyerahkan segala hak serta kepentingan pajakan dan pengurusan tanah itu kepada SPPT Development Sdn Bhd (SPPT) tanpa mengenakan bayaran kepada pihak wakaf.

“Lebih mendukacitakan bagaimana Maidam selaku pentadbir tanah wakaf boleh membiarkan perkara ini berlaku tanpa mengenakan syarat yang lebih menguntungkan wakaf,” katanya di pekarangan Istana Kecil Dalam Kota, Istana Maziah, di sini, semalam.

Beliau berkata, waris tanah wakaf hairan dengan tindakan Maidam bersetuju menerima bayaran hasil pengeluaran kayu balak pada kadar RM3 hingga RM5 per tan, sedangkan kadar bayaran purata ialah sebanyak RM100 per tan.

“Kita juga mempertikaikan keputusan Maidam bersetuju menerima hanya 1.5 hingga 2 peratus jumlah pendapatan pemajak daripada tanaman diusahakan, sedangkan peneroka Felda memperoleh hasil berlipat ganda,” katanya.

Tengku Mohammed Zainal Abidin Petra berkata, pihaknya mempersoalkan kenapa Maidam atau TAA tidak memilih menguruskan harta wakaf itu dan jika ia diusahakan sendiri, pendapatan dihasilkan dianggarkan RM700 juta dengan nilai keuntungan RM365 juta.

Pihaknya turut mempertikai pemilikan saham Maidam dalam pemajak utama, TAA sedangkan pada masa sama Maidam adalah pentadbir tunggal wakaf dan ia jelas ada percanggahan kepentingan.

Tengku Mohammed Zainal Abidin Petra berkata, beliau membuat tuntutan di mahkamah agar perjanjian pajakan dan serah hak dibatalkan kerana semasa perjan-jian dibuat, tanah Chenderong Concession menjadi tanah wakaf.

“Kita juga menuntut supaya hak menguruskan harta wakaf ini dilaksanakan sepenuhnya oleh Maidam di bawah satu unit khas bersama wakil waris atau waris dibenarkan mengurus sendiri melalui penubuhan sebuah syarikat.

“Tuntutan mahkamah ini dilihat sebagai satu tindakan yang positif bertujuan menjaga hak dan kepentingan pewaris wakaf ini daripada terus dikhianati serta mengalami kerugian,” katanya.
